Supervisor and Manager Rights to Membership

When workers are first hired to Supervisory and Managerial positions, they are sometimes told, or erroneously believe, that they can no longer be a member of ANY union, let alone retain their membership in CAPS-UAW, Local 1115. Membership in your union is just as important for Supervisors and Managers as it is for the Rank-and-File workers.

All State Scientific Supervisors and Managers have the right to maintain and/or seek union membership. This right is explicitly stated in the “Excluded Employees Bill of Rights,” in Government Code Section 3530. The section states, in part, “Excluded employee organizations shall have the right to represent their excluded members in their employment relations, including grievances, with the State of California…

CAPS-UAW Scientists organize as members to advocate for safe and respectful workplaces. Additionally, members represent supervisors in their employment with state management. CAPS-UAW Supervisor and Manager members actively work to enhance and safeguard the rights and employment conditions of State Scientists at the worksite, engage with management, and address salary and benefits issues with CalHR. 

As the recognized excluded employee organization for S10 and M10 classifications, your union meets and confers with the State to discuss salaries, benefits, and other employment terms and conditions. CAPS-UAW workers meet and confer with CalHR to enhance and safeguard your and your colleagues’ salaries and benefits, while also representing the interests, rights, and interests of State Scientists.

The raises negotiated through the Bargaining Unit 10 MOU directly impact the subsequent raises for Supervisor and Manager pay. The active participation of Supervisor and Manager Scientists in workplace organizing and actions strengthens the power and bargaining position of all State Scientists.

In times of workplace complaints, investigations, or other job actions, fellow CAPS-UAW Supervisor and Manager Scientists stand by your side and provide guidance on representation matters, consistent with the CAPS-UAW representation policy
