CAPS Attorneys this week will petition the Sacramento Superior Court to issue a Writ of Mandate on the issue of who should be supervising Senior Environmental Scientist Specialists. The Court will schedule a hearing in the coming weeks. This stems from a merit issue complaint CAPS filed with the State Personnel Board in November 2014, objecting to DFW’s announced plan to use Senior Environmental Scientist Supervisors to supervise their Senior ES Specialist peers. SPB delayed its consideration of the matter, saying that it was weighing whether it has jurisdiction over the use of classifications. The SPB, on April 8, 2016, denied jurisdiction in the matter and instead suggested that CAPS seek to negotiate changes with CalHR.  CAPS instead will seek a court order forcing the SPB and the CDFW to reinstate the supervisory reporting relationships provided for in the ES classification series.  For more details on this case, look here: http://capsscientists.org/wp-content/uploads/Merit-Appeal.pdf
